§ 1 Scope of Application

  1. These Terms and Conditions apply to all contracts between CITECH AI GmbH (hereinafter "CITECH") and its clients regarding participation in continuing education programs.
  2. Deviating, conflicting, or supplementary terms and conditions shall not become part of the contract unless their validity is expressly agreed to in writing.

§ 2 Subject of the Contract

  1. CITECH offers continuing education in the field of Artificial Intelligence, in particular the modules "AI User", "AI Specialist", "AI Project Manager", and "AI Manager".
  2. The exact content, dates, and venues are specified in the respective course description.

§ 3 Conclusion of Contract and Registration

  1. The presentation of courses on our website does not constitute a legally binding offer, but rather an invitation to submit an offer.
  2. By registering for a course, the client submits a binding offer to conclude a contract.
  3. The contract is concluded upon our written confirmation of registration.
  4. Places are allocated on a first-come, first-served basis.

§ 4 Prices and Payment Terms

  1. The prices valid at the time of registration shall apply.
  2. All prices are exclusive of the statutory value added tax (VAT).
  3. In the case of funding by the Employment Agency (Arbeitsagentur), Job Center, or other funding bodies, billing is handled directly with the funding body.
  4. For self-payers, the course fee must be paid before the course begins.

§ 5 Withdrawal and Cancellation

5.1 Withdrawal by the Client

  1. Free cancellation is possible up to 14 days before the course starts.
  2. In case of later cancellation, 50% of the course fee is due.
  3. In case of no-show or cancellation on the day of the course, the full course fee is due.

5.2 Withdrawal by CITECH

  1. CITECH reserves the right to cancel courses with insufficient enrollment (fewer than 5 participants) up to 7 days before the course starts.
  2. In this case, fees already paid will be fully refunded.

§ 6 Course Delivery

  1. CITECH is entitled to substitute instructors and make minor changes to the course schedule.
  2. Courses are offered both in-person and online.
  3. For online courses, CITECH provides the necessary software infrastructure.

§ 7 Certificate of Attendance and Certification

  1. Upon successful participation, the client receives a certificate of attendance.
  2. Upon passing the examination, an additional certificate is issued.
  3. A prerequisite is attendance of at least 80% of the instruction time.

§ 8 Copyright

  1. All course materials are protected by copyright.
  2. Reproduction, distribution, or other use is only permitted with the written consent of CITECH.

§ 9 Liability

  1. CITECH is liable without limitation for intent and gross negligence.
  2. In case of slight negligence, CITECH is only liable for the breach of material contractual obligations, limited to the foreseeable, contract-typical damage.
  3. Liability for damages arising from injury to life, body, or health remains unaffected.

§ 10 Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy, available at www.citech-ai.de/datenschutz.

§ 11 Final Provisions

  1. The law of the Federal Republic of Germany shall apply.
  2. The place of jurisdiction is Essen, Germany.
  3. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
